<p>Foreclosure properties in New Orleans are foreclosed using two different methods. One is called the executory method which includes a clause named &#8220;Authentic Act&#8221; that can impart a confession or judgment&#8221; which means that the borrower has legally agreed to the obligations that the mortgage has specified. In case of default, the mortgage company will be authorized to auction the house to recover the loan amount. The other method is the &#8220;Ordinary method&#8221; which is not only expensive but also a time consuming process. It could take anywhere between 9 months to 12 months to complete the foreclosure process. The executory method would only take 3 months for the property to be foreclosed.</p>
<p>Bank auctions of New Orleans are usually advertised in the news papers. Also, these kinds of auctions sell more than one property through a single auction. A bank may have many kinds of properties listed for auctions with them. Also, some properties do not get sold in the first auction and they are repeated again in Bank auctions. Several kinds of properties are displayed in the auctions. All the properties that are getting auctioned however are advertised with the entire information. The information can also be accessed on the internet. The minimum bid amount is always listed, and the winning bidder should clearly bid for an amount above the minimum bid amount.</p>
<p>New Orleans HUD homes are available through public actions and mortgages. People who have defaulted on mortgage payments will have their properties auctioned by the mortgage companies. However, when it comes to HUD homes, the auction is conducted differently. A person who wants to buy a HUD home should already have a pre approved loan in his or her name in order to be eligible for purchasing a HUD home. A detailed check is done of the credit ratings, and only then is the person is authorized to bid for the property. HUD homes are much cheaper to buy than the other homes in any city.</p>
<p>New Orleans Foreclosure homes are foreclosed within three months of initiation. Once the case is filed against the borrower, he is given three days time to pay the amount by the court in the executory method. If the borrower does not respond within 3 days, then the court directly authorizes the lender to conduct an auction. The notice of the auction is directly delivered to the borrower by the lender. Once the notice of auction has been issued, the court also directs the lender to issue the advertisement for public notification through the newspaper. The auction is conducted within three weeks of issuing the notice.</p>

There are two types of in-court foreclosure that can be used, executor process and ordinary process. Executory foreclosure occurs when the bank has used a mortgage that includes in its language &#8220;an authentic act that imparts a confession of judgment&#8221; Basically, this means that the home owner signed and acknowledged the obligations of the mortgage in the presence of a notary public and two witnesses. This type of mortgage makes the foreclosure process a lot easier for the bank. It speeds up the process. Once the suit has been filed along with the original note and a certified copy of the mortgage, the court automatically issues an order for the process to begin.</p>

<p>Once this order is issued, the home owner will then be served with a demand for the back payments. Louisiana gives the home owner only three days to pay the money. Following these three days, if the money is not paid, the court will issue a Writ of Seizure and Sale. The date, time, and place of the sale must be advertised for thirty days before it can be held.</p>
<p>Banks may seek a deficiency judgment. This means they can try to get the former homeowner to pay them the difference between what the house sold for and what the amount owed was. This doesn&#8217;t occur very often, but the bank can sue for that money if they want to.</p>
<p>The former home owner has no right of redemption in this state. A right of redemption is a time period, allowed in most states, during which the person who lost their home to foreclosure can regain ownership of the house by paying either the amount of the loan or the price paid at the sale for the house. This option is not available in Louisiana.</p>
<p>Even though judicial foreclosure usually takes a lot longer than non-judicial foreclosure, Louisiana has streamlined the process and it is one of the quickest states in which the bank can move towards the sale of the home. Sixty days is the average length of the foreclosure process in this state.</p>
<p>The ordinary foreclosure process works more like a lawsuit, and is more costly and time consuming. Consequently, ordinary foreclosure is rarely used by the banks.</p>
<p>In executory foreclosure, the bank is required to send any notification to the home owner, prior to starting the foreclosure process. The mortgage or deed of trust may have language requiring this notification. If it does not, no prior warning will be given to the homeowner.</p>

<p>When a purchaser decides to purchase a home in Louisiana, a good realtor with a large database of available homes to fit the purchaser’s budget should be located. The Purchaser has a choice of homes if the realtor is a member of the National association of Realtors or the Northwest Louisiana Association of Realtors or the Southwest Louisiana Association of Realtors. This is because the realtor will have access to the MLS or Multi Listing Service, which is an inter realtor service that has a data base of every type of home in different residential areas of Louisiana. The purchaser has a greater choice of the type of house and the location. Once the property is located the purchaser makes an offer in the form of a purchase and sale agreement stating the price offered, the down payment, the financing plans, the legal description of the house, good and marketable title, inspections required under law, the time frame in which each stage of the transaction is to be completed the liens and who bears the costs if the house is damaged before the settlement. The offer is sent with a check to be kept by the realtor in escrow and to be paid to the seller. The seller, on receipt of the offer is required under the Laws of the State of Louisiana to make a complete disclosure of the present and potential defects of the property both structural and environmental if the property is residential. The seller’s disclosure form has 22 disclosures to be made by the seller. If the seller does not know of any defect it should be stated in the form. The disclosure is not a warranty by the seller and the purchaser must carry out inspections. Once these tasks are completed the seller and the purchaser will sign the agreement and make it a binding contract.</p>
<p>The purchaser should hire an attorney, a real estate title company or a trust and title company to scrutinize the title of the property and to check public and court records for possible encumbrances of the title of the property. The American Land Title association has a list of title search professionals the for the purchaser’s reference. Encumbrances that affect the title of property in the State of Louisiana are, implied easements of necessity which is recognized by law. Other encumbrances are liens on the property arising out of non payment of amounts due under judgments, unpaid taxes assessments unpaid mechanics. Any encumbrance that can be remedied is communicated to the seller. The purchaser should buy a title insurance to avoid the litigation costs in defending possible title claims. that were not discovered by the title search. The purchaser can then raise the loan from the lender company and make the down payment. When the lender company is satisfied that all the paperwork is complete, the purchase is ready for closure. Under the Authentication Act in the <a href="http://www.clicklouisiana.com/" target="_blank"><strong>state of Louisiana</strong></a> the closing should take place in a Notary Public’s office. The website of the American association of Notaries has a notary locator directory to help the purchaser find a notary in Louisiana. The Notary Public is usually an attorney who has experience in examining titles. The purchaser is required to show proof of a one year home owners insurance premium payment and a proof of identity at the closure when the deed is signed by both parties. The deed should be signed and authentication by the Notary public and two witnesses otherwise the document is deemed invalid in the State of Louisiana. When the Notary Public records the sale, the seller passes possession and title to the purchaser and the purchaser finishes the process of purchasing a home in the State of Louisiana.</p>

<p>Louisiana</p>
<p>Louisiana has obviously been in the news because of the devastation caused by Hurricane Katrina. To say the entire episode is a tragedy is to understate the obvious. Louisiana is a state that has overcome problems before and it will do it again. For the purposes of this article, I am going to discuss the state pre-hurricane because, frankly, the state will recover within a year or so. It has done it before.</p>
<p>Louisiana is a state with an absolute ton of character. In fact, you will find no other state in the country that can match it. There is a heavy French influence and the people, towns and cities are eclectic to say the least. From plantations to Mardi Gras to funky little towns to incredible food and music, Louisiana is state that can capture your imagination.</p>
<p>New Orleans</p>
<p>Yes, New Orleans took a beating in the hurricane and subsequent flooding. This was not the first hurricane to cause damage and the city will recover. If you base your opinion of the city on the things you saw on the television or heard in the media, you are making a mistake. This is a city with extremes in many areas, from food to music to lifestyles and so on.</p>

<p>New Orleans is like no other city in the country. Here you will find fire-eaters and street artists, old river steamboats, food to die for, old plantation homes and a music scene that can&#8217;t be beat. The French Quarter is beautiful and chaotic, particularly during Mardi Gras. Walking through the city, you&#8217;ll find little street markets, walk up eateries and eclectic little spots like the Voodoo Museum. The redeveloped River Walk area on the Mississippi River is a good spot to while away the hours as are the tours around the city. Keep in mind, New Orleans is the home of author Anne Rice and the location of her Vampire Chronicles book series. Words will never accurately describe New Orleans, it is just a place you have to investigate. You will either love the chaos or hate it.</p>
<p>Baton Rouge</p>
<p>The state capitol of Louisiana, Baton Rouge is New Orleans without the edge. An easygoing city with a heavy French influence, the city feels more like a place you could actually live in compared to New Orleans. Although the city was hit by Hurricane Katrina, it did not suffer the devastation seen in other locations. Home to Louisiana State University, the city has a college feel with college football being the name of the game.</p>
<p>Louisiana Real Estate</p>
<p>Obviously, figures for Louisiana real estate are irrelevant following the events of this year. Generally, single-family homes averaged $200,000 throughout the state prior to the hurricane. Appreciation rates were also a modest 6.5 percent.</p>
<p>If there is a silver lining to Hurricane Katrina, it is the redevelopment that will occur throughout the state. Hundreds of billions of dollars are flowing into the state, which will lead to a major makeover. New Orleans, in particular, is going to get a major face-lift with as many as 40,000 structures being replaced. As things settle down, real estate opportunities may be plentiful.</p>
